PENDAHULUAN

Firma Hukum ANNER MANGATUR SIANIPAR, SH, MH & PARTNERS (AMS Law Firm) didirikan di Surabaya (Jawa Timur) pada Januari 1997 oleh ANNER MANGATUR SIANIPAR, SH, MH, atau dikenal juga sebagai MANGATUR SIANIPAR, SH, MH, yang pada saat itu juga masih bekerja sebagai Branch Manager di Surabaya pada P.T. CISI Raya Utama & P.T. CAPRICORN INDONESIA CONSULT Inc. (The CIC Consulting Group), perusahaan yang bergerak di bidang konsultan data business dan marketing & industrial research, yang berpusat di Jakarta Pusat. Sejak mengundurkan diri dari The CIC Consulting Group, yang bersangkutan selanjutnya total bekerja dan mengembangkan firma hukum ini hingga saat ini.

Show more Universitas Sumatera Utara (USU) Medan dan Magister Hukum di bidang konsentrasi Hukum Bisnis dan Perusahaan. Saat ini, firma hukum ini mengelola 3 (tiga) kantor, masing-masing di Surabaya (Jawa Timur), Jakarta dan Balikpapan (Kalimantan Timur).

Dalam kurun waktu kurang lebih 15 (lima belas) tahun ini, firma ini telah mampu menyelesaikan sekitar 500 (lima ratus lima puluh) perkara litigasi dan sekitar 850 (delapan ratus lima puluh) jasa konsultasi hukum, terutama di bidang hukum perdata, bisnis dan pidana, dengan klien utama adalah perusahaan lokal dan asing, berskala menengah dan besar. Saat ini, firma ini dikelola oleh sekitar 15 (lima belas) orang Advokat / Pengacara senior dan sejumlah paralegal muda yang dinamis dan ambisius, yang telah berpengalaman sekitar 15 (lima belas) tahun sebagai Advokat/Pengacara dan Konsultan Hukum.

Pelayanan yang prima, efektif dan effisien dalam membela kepentingan Hukum Klien sesuai dengan hukum, kebenaran & keadilan “TANPA MENJANJIKAN SUATU KEMENANGAN”, adalah Motto dari ANNER MANGATUR SIANIPAR, SH, MH & PARTNERS (AMS Law Firm). TIPS : TEHNIK MEMILIH & MENGGUNAKAN JASA ADVOKAT (ADVOCATES/ LAWYER)

1. Pengertian ADVOKAT/PENGACARA (Advocates/Lawyer)

Advokat dalam Bahasa Indonesia sehari-hari lebih sering/populer disebut sebagai Pengacara atau Konsultan Hukum. Namun, sejak diundangkannya UU No. 18 Tahun 2003 tentang “Advokat”, sebagai undang-undang pertama yang lahir sejak kemerdekaan Republik Indonesia yang khusus mengatur tentang keberadaan Advokat sebagai suatu profesi yang yang bebas, mandiri, dan bertanggung jawab dalam menegakkan hukum dan perlunya untuk dijamin dan dilindungi oleh undang-undang demi terselenggaranya upaya penegakan supremasi hukum, istilah yang dipergunakan hanya Advokat, tidak lagi mengenal istilah “Pengacara”. Undang-undang No. 18 Tahun 2003 telah mencabut dan menyatakan tidak berlaku lagi beberapa peraturan lama produk zaman kolonial yang mengatur tentang keberadaan Advokat/Pengacara yaitu Reglement op de Rechterlijke Organisatie en het Beleid der Justitie in Indonesie (Stb. 1847 Nomor 23 jo. Stb. 1848 Nomor 57), Pasal 185 sampai Pasal 192 dengan segala perubahan dan penambahannya, Bepalingen betreffende het kostuum der Rechterlijke Ambtenaren dat der Advokaten, procureurs en Deuwaarders (Stb. 1848 Nomor 8), Bevoegdheid departement hoofd in burgelijke zaken van land (Stb. 1910 Nomor 446 jo. Stb. 1922 Nomor 523), dan Vertegenwoordiging van de land in rechten (K.B.S 1922 Nomor 522).
Namun, karena istilah Pengacara masih sangat melekat dalam benak dan kehidupan masyarakat sehari-hari, maka dalam konteks ini, kami masih memakai istilah Pengacara untuk mendampingi kata Advokat. Advokat/ Pengacara memberikan jasa hukum kepada kliennya dengan penuh dedikasi, tanggungjawab dan profesionalitas, berupa konsultasi hukum, bantuan hukum, menjalankan kuasa, mewakili, mendampingi, membela, dan melakukan tindakan hukum lain untuk kepentingan hukum klien, baik di dalam maupun di luar pengadilan. Berdasarkan hasil verifikasi tahun 2010, diketahui jumlah Advokat/ Pengacara yang terdaftar pada PERADI (Perhimpunan Advokat Indonesia) berjumlah lebih kurang 21.000 orang, dan masih banyak yang belum diambil sumpahnya oleh Pengadilan Tinggi, sehingga saat ini tidak sulit untuk mencari dan menemukan Advokat/Pengacara di Indonesia, terutama di kota-kota besar bahkan hingga tingkat Kabupaten dan Kecamatan. Justru, yang terkadang terasa sulit adalah untuk memilih atau menentukan Advokat/Pengacara sesuai dengan kebutuhan hukumnya. Sebab yang kita inginkan bukanlah semata-mata Advokat / Pengacara yang memiliki papan nama beken atau Advokat/ Pengacara Selebritis yang sering muncul di televisi atau media massa lainnya. Advokat / Pengacara yang dibutuhkan adalah yang profesional dan memiliki reputasi baik, ulet, jujur dan memiliki integritas moral yang baik, tidak seperti pisau bermata dua. Kebutuhan akan jasa Advokat / Pengacara dewasa ini terasa penting seiring dengan peningkatan kesadaran hukum masyarakat maupun pertumbuhan bisnis yang sangat pesat dan kompleks.


2. Tips Memilih (Advokat/Pengacara) Yang Profesional

Proses memilih Advokat / Pengacara sesuai dengan kebutuhan hukumnya adalah hampir sama dengan proses memilih Dokter, Akuntan, Notaris, Arsitek dan pekerja profesional lainnya. Tentu dengan menjamin profesionalisme dalam pekerjaannya, seorang Advokat/Pengacara harus mampu memberikan pelayanan yang terbaik bagi klien, sehingga klien dapat menilai dan percaya akan kwalitas kerja si Advokat/Pengacara. Perlu kehati-hatian dan ketelitian klien dalam memilih dan menentukan Advokat/Pengacara untuk menangani urusan hukumnya. Agar tidak keliru dalam memilih Advokat/Pengacara yang dibutuhkan, perlu ditempuh beberapa tips di bawah ini :


a. Pastikan bahwa si Advokat/ Pengacara tersebut benar-benar merupakan Advokat / Pengacara resmi yang memiliki izin praktek yang masih berlaku, bukan pengacara “gadungan” atau ”Pokrol”.
b. Pastikan bahwa si Advokat/ Pengacara memiliki kwalifikasi yang baik dalam bidang hukum tersebut.
c. Pastikan bahwa si Advokat/ Pengacara tidak memiliki konflik kepentingan (conflict of interest) dalam kasus yang ditangani.
d. Pastikan bahwa si Advokat/ Pengacara tidak akan melakukan kongkalikong dengan pihak lawan atau Advokat/ Pengacara pihak lawan.
e. Pastikan bahwa si Advokat/ Pengacara tersebut memiliki track record yang baik dalam keadvokatan / Pengacaraan, termasuk menyangkut etika, moral dan kejujurannya.
f. Pastikan bahwa si Advokat/ Pengacara tersebut tidak pernah terlibat dalam malpraktek hukum.
g. Pastikan bahwa si Advokat/ Pengacara adalah type pekerja keras dan berdedikasi tinggi akan profesinya serta benar bekerja demi kepentingan kliennya, bukan Advokat/ Pengacara yang hanya pintar bicara lalu minta bayaran tetapi tidak becus membela kepentingan kliennya.
h. Jika anda ragu akan kredibilitas seorang Advokat/ Pengacara, mintalah foto copy Izin Praktek Advokat yang bersangkutan (berwarna biru) yang diterbitkan oleh diterbitkan oleh PERADI (Perhimpunan Advokat Indonesia) dan perhatikan masa berlaku kartu advokat tersebut, bukan kop suratnya, atau mintalah informasi tentang si Advokat/ Pengacara tersebut langsung kepada asosiasi-asosiasi Advokat/Pengacara resmi yang diakui oleh undang-undang yaitu : Ikatan Advokat Indonesia (IKADIN), Asosiasi Advokat Indonesia (AAI), Ikatan Penasihat Hukum Indonesia (IPHI), Himpunan Advokat dan Pengacara Indonesia (HAPI), Serikat Pengacara Indonesia (SPI), Asosiasi Konsultan Hukum Indonesia (AKHI), Himpunan Konsultan Hukum Pasar Modal (HKHPM) dan Asosiasi Pengacara Syariah Indonesia (APSI).
i. Bahwa, jika anda diperlakukan tidak sepatutnya oleh oknum Advokat/ Pengacara, maka anda dapat melaporkan yang bersangkutan kepada Dewan Kehormatan Profesi Advokat yang telah ditetapkan oleh Ikatan Advokat Indonesia (IKADIN), Asosiasi Advokat Indonesia (AAI), Ikatan Penasihat Hukum Indonesia (IPHI), Himpunan Advokat dan Pengacara Indonesia (HAPI), Serikat Pengacara Indonesia (SPI), Asosiasi Konsultan Hukum Indonesia (AKHI), dan Himpunan Konsultan Hukum Pasar Modal (HKHPM).

3. Tips Menghindari Konflik Antara Klien Dengan Advokat/Pengacara.


Belakangan ini sering kita mendengar atau membaca di berbagai mass media perselisihan antara klien dengan si Advokat/Pengacara, baik menyangkut proses penanganan kasus maupun menyangkut soal pembayaran fee atau success fee si Advokat/Pengacara. Bahkan ada kejadian klien yang melaporkan si Advokat/Pengacara ke Kepolisian dengan tuduhan menggelapkan uang atau barang milik si klien atau karena Advokat/Pengacara telah meminta/menerima sejumlah uang dari klien untuk upaya memenangkan perkara dengan ”janji-janji PASTI MENANG”, namun tidak berhasil atau tidak dilakukan sama sekali oleh si Advokat / Pengacara, yang berakibat si Advokat/Pengacara ditahan. Untuk menghindari hal yang demikian ini perlu diantisipasi di awal kesepakatan sebelum menandatangani Surat Kuasa bagi si Advokat / Pengacara, dengan melakukan beberapa hal, diantaranya :

a. Membicarakan secara detail dan tuntas mengenai besarnya Lawyer Fee maupun Success Fee-nya jika berhasil memenangkan perkara yang ditangani.
b. Kesepakatan tersebut di atas (point a) ini sebaiknya dituangkan dalam suatu perjanjian tersendiri tentang “honorariun” yang menyangkut besarnya operasional cost maupun success fee yang harus diberikan oleh klien bagi si Advokat/ Pengacara maupun tata cara pembayarannya.
c. Perlu diatur secara jelas dan tegas tentang ada atau tidaknya “hak substitusi” bagi Advokat/Pengacara tersebut, yaitu hak untuk menguasakan kembali baik sebagian maupun seluruhnya dari yang dikuasakan Klien kepadanya tersebut kepada orang lain lagi.
d. Perlu diatur secara jelas dan tegas tentang ada atau tidaknya “hak retensi” bagi Advokat / Pengacara tersebut, yaitu hak untuk menahan surat-surat atau barang-barang milik Klien yang berada dalam penguasaan Advokat/Pengacara selama hak-haknya sesuai dengan yang telah diperjanjikan belum atau tidak dipenuhi oleh Klien, untuk menghindari tuntutan hukum kepada Advokat / Pengacara dari Klien dengan tuduhan telah melakukan tindak pidana penggelapan harta milik / barang milik si Klien.
e. Klien tidak boleh terlalu mencampuri masalah teknik dan taktik berperkara baik di dalam maupun di luar pengadilan, termasuk menyangkut proses administrasi di pengadilan atau instansi lainnya.
f. Klien tidak boleh melakukan deal-deal dengan pihak manapun termasuk perdamaian dengan pihak lawan tanpa memberitahukannya terlebih dahulu kepada si Advokat/ Pengacara.
g. Advokat/Pengacara tidak boleh menjanjikan suatu kemenangan dengan kata-kata “PASTI MENANG” kepada Klien, karena hal itu melanggar Kode Etik Advokat Indonesia.

4. Fee Advokat/Pengacara.

Masyarakat perlu mengetahui bagaimana Lawyer Fee (honorarium Advokat/ Pengacara) yang harus kita berikan atas jasa Advokat/Pengacara. Tidak ada suatu standar penentuan lawyer fee di kalangan Advokat/Pengacara. Besar kecilnya honorarium yang akan diterima oleh Advokat/Pengacara sangat tergantung kepada kesepakatan kedua belah pihak, klien dan Advokat/Pengacara yang didasarkan kepada beberapa hal, antara lain :

a. Profesionalitas si Advokat/ Pengacara (semakin terkenal berarti semakin mahal)
b. Besar kecilnya kasus yang ditangani.
c. Lamanya waktu yang dibutuhkan untuk menyelesaikan perkara tersebut.
d. Kemampuan financial si klien.
e. Lokasi kasus / perkara yang ditangani (kalau di luar daerah / pulau berarti semakin mahal dengan penambahan biaya akomodasi dan transportasi).

Menurut AMS Law Firm (ANNER MANGATUR SIANIPAR, SH, MH & Partners), setidaknya ada 5 (lima) kriteria dan metode pembayaran dalam memanfaatkan jasa Advokat/Pengacara antara lain:

a. Pembayaran borongan, dimana Advokat/Pengacara memperoleh bayaran yang sudah ditentukan besarnya hingga perkara tersebut tuntas ditangani, di luar success fee. Jadi, kalah atau menang dalam menangani suatu perkara, si Advokat/ Pengacara tetap menerima fee sebesar yang telah diperjanjikan semula, yang tatacara dan termin pembayarannya telah disepakati bersama, dimana pada saat penandatangan Surat Kuasa biasanya sudah dilakukan pembayaran sekitar 30% hingga 50% dari total fee yang harus diterima dan selanjutnya disesuaikan dengan porsi pekerjaan yang sudah dilakukan, yang umumnya pembayaran tersebut dilakukan antara 2 (dua) hingga 3 (tiga) termin, dimana biasanya sekitar 5% hingga 10% dibayarkan setelah perkara selesai. Jika, sebelumnya telah diperjanjikan, maka si Advokat/ Pengacara masih dimungkinkan untuk mendapatkan success fee selain dari fee/honorariumnya tersebut. Namun, dalam sistem ini biasanya sudah digabung menjadi satu paket (all in) dengan success fee-nya.

b. Pembayaran berdasarkan porsi pada sistem ini Advokat/Pengacara menerima bagian dari hasil yang diperoleh dari klien yang dimenangkan dalam suatu sengketa hukum. Namun, Advokat/Pengacara disini hanya akan menerima bagian jika ia berhasil memenangkan perkara tersebut (success fee). Jika tidak berhasil, maka dia hanya akan menerima penggantian untuk biaya operasional yang telah dikeluarkannya. Pembayaran berdasarkan porsi seperti ini tidak dilakukan dalam masalah–masalah bisnis rutin. Sistem seperti ini umumnya dipergunakan dalam hal Advokat/Pengacara bekerja dan mewakili klien untuk kasus sengketa melalui proses litigasi (sengketa yang penyelesaiannya melalui proses di pengadilan/kepolisian/kejaksaan), mediasi atau arbitrase seperti dalam suatu peristiwa dimana terjadinya tuntutan (gugatan) atas kerugian akibat kelalaian atau kesalahan pihak lain yang klien alami.

c. Pembayaran per jam, biasanya cara pembayaran seperti ini dilakukan untuk jasa dalam lingkup bisnis kecil. Penting diketahui bahwa setiap aktifitas seorang Advokat/Pengacara dalam mewakili kepentingan klien termasuk dalam biaya dan jasa telepon untuk konsultasi dan hal-hal lain seperti surat menyurat untuk kepentingan legal advise, mempersiapkan dan menyusun suatu rancangan kontrak juga termasuk dalam perhitungan “Jam“ jasa yang harus dibayarkan. Jika metode ini yang digunakan, maka saat calon Klien mengadakan pembicaraan dengan calon Advokat/Pengacara yang dipilih harus terlebih dahulu ditanyakan berapa tarif per jam si Advokat/Pengacara dan waktu minimum pemakaian jasanya. Kebanyakan Advokat/Pengacara menggunakan waktu minimum untuk pemakaian jasanya adala 15 (lima belas) menit. Dalam suatu contoh, apabila seorang klien menelepon selama tujuh menit maka akan dibebankan biaya atas pemakaian jasa 15 (lima belas) menit. Di kota-kota besar biasanya tarif per jamnya ditentukan dengan standard US$, yang saat ini di Jakarta rata-rata berkisar antara US$ 250 hingga US$ 750 per jam untuk seorang Advokat/Pengacara senior dan terkenal, dan antara US$ 75 hingga US$ 250 per jam untuk seorang Advokat/Pengacara junior dan menengah. Metode ini kurang cocok untuk perkara litigasi (sengketa yang penyelesaiannya melalui proses di pengadilan /kepolisian /kejaksaan) yang besar dan membutuhkan waktu yang lama untuk penanganannya.

d. Pembayaran ditetapkan Advokat/ Pengacara yang akan menangani suatu tugas atau proyek biasanya menentukan sistem pembayaran tetap (Fixed Rate). Namun sistem ini tidak dipakai pelayanan jasa dalam lingkup litigasi (sengketa yang penyelesaian- nya melalui proses di pengadilan/ kepolisian/kejaksaan). Sistem ini biasanya diterapkan pada pemanfaatan jasa oleh bisnis skala kecil. Contohnya, seorang Advokat/ Pengacara menetapkan fixed rate untuk menghasilkan suatu kontrak atau dokumen.

e. Pembayaran berkala jika seorang Advokat/Pengacara menggunakan sistem pembayaran berkala, maka klien membayar secara bulanan atau bisa juga dirancang untuk pembayaran secara per triwulan, semester atau tahunan sebelum berbagai jasa Advokat/Pengacara diterima klien (pembayaran di depan) dan harus didefinisikan (dirinci) untuk disepakati bersama. Sistem ini sangat menguntungkan bagi klien, terutama jika klien tahu bahwa mereka akan sering membutuhkan Advokat/ Pengacara dalam suatu periode tertentu. Pembayaran model ini biasanya di luar perkara, biasanya untuk jasa konsultasi saja. Metode ini lebih mudah, effisien dan effektif.

Setelah memilih Advokat/Pengacara dan besarnya biaya yang harus ditanggung serta menentukan cara pembayarannya yakinkan bahwa untuk menghindari masalah yang mungkin muncul di kemudian hari untuk itu sebaiknya senantiasa meminta salinan (copy) dari surat kuasa, perjanjian honorarium dan dokumen penting lainnya sehingga Klien dapat secara langsung menilai dan mengarahkannya dengan tetap memperhatikan nasihat dan pertimbangan hukum dari Advokat/ Pengacara ini, tanpa harus mencampuri urusan teknik dan taktik berperkara yang dijalankan Advokat/ Pengacara untuk kepentingan Kliennya. 1. The understanding of advocate / lawyer

Advocate in Bahasa Indonesia daily is more frequent/popular to call as an Advocate or Law Consultant. But, since it is issued the Law Number 18 in the Year of 2003 about “Advocate”, as the first law which is issued since the Indonesian Republic freedom specially rules about the advocate existence as a profession which is free, independent, and responsible for confirming laws and it needs to be sustained and protected by the laws for holding efforts if law supremacy confirmation, the term which is used only by advocate, it is no longer to be known as the term “advocate”. By the year 2003, The Law Number 18 has withdrawn and stated they are invalid again about several old rules of products in colonial era which rules about the advocate/lawyer existence, i.e. Reglement op de Rechterlijke Organisatie en het Beleid der Justitie in Indonesie (Stb. 1847 Number 23 jo. Stb 1848 Number 57), Section 185 to Section 192 with all changes and additions, Bepalingen betreffende het kostuum der Rechterlijke Ambtenaren dat er Advokaten, procureurs en Deuwaarders (Stb. 1910 Number 446 jo. Stb. 1992 Number 523), and Vertegenwoordiging van de land in rechten (K.B.S 1992 Number 522). In fact, the term Advocate is still extremely attached in society’s mind and life daily, so in this context, we still use the term lawyer for accompanying the word advocate. Advocates / Lawyers provide the law service to their clients in full of dedication, responsibility and professionality. These include law consultation, law assistance, undergoing the power, representing, accompanying, caring for, and coping the other law actions for the importances of client law both inside and outside of the court. According to the verification result in year of 2010, it is known the numbers of Advocates / Lawyers who are registered at Indonesian Advocates Association (PERADI) has reached with total approximately 21,000 people, and many are yet to be sworn by the Court of Appeal, so as a result today it is not difficult to seek and find Advocates / Lawyers in Indonesia, especially from metropolitan to Regency and District Regions. The Advocates / Lawyers who are being chosen are the professional ones. They should have good reputation, perseverance, honesty, and good moral integrity, are not like two-eyes sword. The recent needs for Advocate / Lawyers service indicate the important as relevant as the society law consideration, which increase rapidly in the complex business development and community.





2. Tips of Selecting The Professional Advocates/Lawyers

The processes of selecting Advocates/ Lawyers as the law needs are almost the same with the processes of selecting Doctors, Accountants, Notaries, Architects, and other professional worker. Being committed the professionalism in his or her work, an Advocate/Lawyer must be able to accomodate the best service for a valuable client. Therefore the client can value and trust the work quality of the Advocate/Lawyer, too clients need to be careful and care in selecting and determining the Advocate/Lawyer to overcome his law concerns. In order to avoid wrong decision in selecting the Advocate/Lawyer, they needs to aware several points as follow :


a. Be sure that the Advocate/Lawyer really is an official Advocate/Lawyer who has owned a practice license which is still valid, not a “bogus” advocate or “Attorney”.

b. Be sure that the Advocate/Lawyer has a good qualification in the law field.
c. Be sure that the Advocate/Lawyer does not have conflict of interest in the settled cases.

d. Be sure that the Advocate/Lawyer will not execute the intrigue with the opposite party or the Advocate/Lawyer of opposite party.
e. Be sure that the Advocate/Lawyer has a good track record in the Advocacy includes relating to the ethics, moral, and honesty.
f. Be sure that the Advocate/Lawyer has never involved in the law malpractice.
g. Be sure that the Advocate/Lawyer has strong personality in hard working and has a high dedication about his or her profession and also really worker for the client importance, not the Advocate/ Lawyer that is smart of speaking then asking for payment, but he or she is not capable to protect and care for the client importance.
h. If you doubt the credibility of an Advocate/Lawyer, please ask for the copies of the related Advocate Practice License (the color is blue) which are published by PERADI (Indonesian Advocates/ Lawyers Association), and note the card validity period of such Advocate/Lawyer, it is not the letterhead, or ask for the information about the official Advocates/Lawyers directly to the official Advocates/Lawyers Association which is admitted by the laws such as : Indonesian Advocates Group, Indonesian Advocates Association, Indonesian Law Advisor Group, Indonesian Advocates and Lawyers Club, Indonesian Advocates Union, Indonesian Law Consultant Association, Capital Market Law Consultant Club, and Indonesian Syariah Advocates Association.




i. If you are treated improperly by the Advocate/Lawyer person, you can report his or her act to Advocate Profession Honor Board, which is stated by Indonesian Advocates Group, Indonesian Advocates Association, Indonesian Law Consultant Group, Indonesian Advocates and Lawyers Club, Indonesian Advocates Union, Indonesian Law Consultant Association, and Capital Market Law Consultant.






3. Tips of avoiding the conflicts acknowledge from between client and Advocate/Lawyer.

In recent days, we often hear or acknowledge mass media mentioning, the conflicts between client and Advocate/Lawyer, both relating the processes of conducting cases and relating the problems of final fee payment or success fee of Advocate/Lawyer. In fact, there are several instances where a client who reported the Advocate/Lawyer to police with the accusation of embezzling client’s money or goods belonging to client or because the Advocate/Lawyer has requested/received for some money from the client to attempt to win the caes with promise “SURE WIN”, however, it is not successful or it is not done at all by the Advocate/Lawyer, which causes the Advocate/Lawyer is arrested. For avoiding such case, it needs to anticipate in the beginning of agreement before signing the Authority Letter for the Advocate/Lawyer by doing several, such as:

a. Telling in detail and complete about the amounts of Lawyer Fee and Fee Success if it is successful to win the settled case.

b. The agreement above (point a) is better to mention in a separated agreement about “honorarium”, which relates the amounts of operational cost and success fee which must be given by the client for the Advocate/Lawyer and the payment terms.

c. It needs to rule clearly and firmly about there is an existence or not of “substitution right” for the Advocate/Lawyer, that is the right for mastering again both the part and all things from which is authorized the client to him or her for others again.
d. It needs to rule clearly and firmly about the existence of “retention right” or not for the Advocate/Lawyer, that is the right for retaining the letters or stuffs of client which are in the Advocate/Lawyer mastery during the rights are appropriate with which have been approved and have not been fulfilled or yet from the client with the accusation that he or she has done the emblezzlement crime of client’s properties/stuffs.

e. Clients should not be too interfering techniques and tactics of litigants problems both inside and outside of court, including administrative processes concerning the litigation or other agencies.

f. Clients can not do deal with any party, include the reconciliation with the opposite side without telling first to the Advocate/Lawyer.

g. Advocates/Lawyers should not promise a victory with the words "SURE WIN" to the client, because it violated the Code of Ethics Advocate Indonesia.



4. Advocate/Lawyer Fee.

Client or public community need to know how the Lawyer Fee (Advocate/Lawyer’s honorarium) which must submit to the Advocate/Lawyer. There is no much standard lawyer fee determination in the Advocate/Lawyer circumtances. More or less honorarium, which will be paid to the Advocate/Lawyer, depends to the both parties agreement. The client and Advocate/Lawyer generally measured on several terms and conditions much as :

a. The Advocate/Lawyer Professionality (more reputable, reliability Advocate / Lawyer in the public society means more expensive fees)
b. The member of different cases are to be settled.
c. The number period of time which is required for solving the case.
d. The client’s financial ability.
e. The case location which is settled (if outside of the area/island, it means more expensive by adding the accommodation and transportation fees).

According to AMS Law Firm (ANNER MANGATUR SIANIPAS, SH, MH & Partners), at least there are 5 (five) criterias and payment methods in utilizing the Advocate/Lawyer service such as:

a. Contract Fee, in which the Advocate / Lawyer gains the payment which has been determined the amounts of it, so the case is settled completely outside of the success fee. So, if it loses or wins in conducting such case, the Advocate/Lawyer still provide the fee as amount as the ones which have been approved together, in which at the time of signing the Authority Letter, it usually has been done the payment about 30% to 50% from the fee totals which must be received and then it is adjusted to the work portions which have been done, generally the payment is done between 2 (two) to 3 (three) terminations, usually it is about 5% to 10% payed after the case has finished. If before, it has been approved, so the Advocate/Lawyer is still possible to get the success fee besides the fee/honorarium. But, in this system, it usually has been joined into one packet (all in) with the success fee.





b. Contingent Fees on this system is that the Advocate/Lawyer receives the parts from the gained results from the client who is won in a law conflict. But, here the Advocate/Lawyer will only receive the portion if he or she is successfully win the case (success fee). If it is not successful, then he or she will only acquire the substitution for the operational fees which have been spent. The payment based on the portion such this is not done in the routine business problems.This system is generally used in the case of the Advocate/Lawyer who works and represents the client for the conflict case through the litigation processes (the conflict which the settlement through the process in the court/ police/prosecutor), mediation or arbitration as in some event where it happens the claim for the loss of negligence or the other side guilt which the client experiences.



c. Hourly Rate, usually the payment method is done for the service in the small business environment. It is necessary to know that each activity of an Advocate/Lawyer in representing the client importances include in telephone cost and service for consultation and other things such as correspondence for legal advise importance, preparing and composing a contract plan. They includes in calculation of service “hour” which must be payed. If this method which is used, so if the client candidate holds a speech with the chosen Advocate/Lawyer candidate must be firstly asked how much tariff per hour is for the Advocate/Lawyer and the time of minimal service usage. Mostly the Advocate/Lawyer uses the minimal time for using his or her service for 15 (fifteen minutes). In an example, if a client makes telephone for seven minutes, so it will be charged the cost for the service usage for 15 (fifteen minutes). In metropolises, the tariff per hour is usually determined by US$ standard, which is today in Jakarta averagely ranges from US$ 250 to US$ 750 per hour for a senior and well-known Advocate /Lawyer, and ranges from US$ 75 to US$ 250 per hour for a junior and middle Advocate/Lawyer. This term is less appropriate with litigation cases (conflicts which the solution is through the process in the court/police/prosecutor) which are huge and needs a long time for settle them.





d. Fixed Rate of the Advocate/Lawyer who will handle a task or project usually determines the Fixed Rate system. But this system is not used by the service in litigation scopes (conflicts which the solution is through the process in the court/police/ prosecutor). This system is usually applied at the service utility by the small scale business. For example : an Advocate/Lawyer determines fixed rate for resulting a contract or document.



e. Retainer if an Advocate/Lawyer uses the periodical payment system, so the client pays monthly fees or he can choose and decide for the payment per quarterly, semesterly, or yearly before several services of Advocate/Lawyer are received by the client (in cash) and it must be defined (detailed) to be decided together. This method is very beneficial for the client, primarilly if the client aware that they will often need Advocate/Lawyer in a certain period of time. The payment of matter is usually outside of the case, usually for the consultation service only. This method is much easier, efficient, and effective way.



5. Conclusion

After selecting an Advocate/Lawyer and the amount of costs which must be guaranteed and determining the way of payment to ensure that for avoiding the cases which may appear later, for that it should request for a sheet of copy paper from the authorized letter permanently, honorarium agreement and another important documents so that the client can make a judgement and proceed them with still pay attention to the law advice and consirable law from Advocate/Lawyer, without interfere with the technical concerns and case tactics which have undergone by the Advocate/Lawyer for the client importances.
